SMS Consent and Text Messaging Terms

These SMS Consent and Text Messaging Terms (the “SMS Terms”) describe the text messaging program that Multifactor, Inc. (“Company”, “we”, “us”, and “our”) operates as part of Solid2FA, how you consent to receive text messages from us, and how you can opt out. The SMS Terms are incorporated by reference into our Terms of Use, and our Privacy Policy describes how we handle the information involved. Capitalized terms that are not defined here have the meanings given in the Terms of Use.

Text messaging is optional. You can create an Account and use the Site and the Services, including Solid2FA, without agreeing to receive text messages. Consent to receive text messages is not a condition of purchasing any goods or services from us. We send text messages to a mobile telephone number only after you have provided that number and opted in as described in Section 2.

1. THE SOLID2FA TEXT MESSAGING PROGRAM

Program name: Multifactor Solid2FA (the “Program”). Sender: Multifactor, Inc.

Solid2FA lets you receive one-time verification codes and other account messages from third-party services that you use, such as banks, email providers, and social networks (each a “Linked Service”), at a virtual telephone number that we assign to you (your “Solid2FA Number”) instead of at your personal number. Messages that a Linked Service sends to your Solid2FA Number are received by systems we control, encrypted to keys that only you hold, and shown to you inside the Multifactor application.

If you opt in to the Program, we may send the following types of text messages to the mobile telephone number that you provide (your “Mobile Number”):

  1. Verification messages. A one-time code to confirm that you control your Mobile Number when you add it, and again if you change it.
  2. Relayed messages. Copies of messages that a Linked Service sends to your Solid2FA Number (such as verification codes, sign-in alerts, delivery notifications, and other account messages), according to the delivery options you choose in Settings.
  3. Program messages. Messages about the Program itself, such as an opt-in confirmation, responses to HELP and STOP requests, and notices that affect your Solid2FA Number or your delivery settings.

Messages in the Program are informational and transactional. We do not send marketing or promotional text messages under the Program, and we will not send you marketing text messages unless you separately give us your express written consent to receive them.

Messages are sent from telephone numbers operated by us or by our messaging providers on our behalf, and each message identifies Multifactor as the sender. Relayed messages are sent by our application to you, the holder of the Account to which the Solid2FA Number is assigned; the Program is not a personal phone line and does not send messages between individuals. Replies that you send to a text message from us, other than the keywords described in Sections 5 and 6, are not delivered to the Linked Service that originally sent the message.

2. HOW YOU OPT IN

You opt in to the Program inside the Multifactor application by: (a) entering your Mobile Number in the Solid2FA section of Settings; (b) affirmatively selecting an unchecked consent control, which is separate from your acceptance of the Terms of Use and Privacy Policy, that presents substantially the following disclosure; and (c) entering the one-time code that we text to your Mobile Number to confirm that you control it.

I agree to receive recurring text messages from Multifactor (Solid2FA) at this number, including one-time verification codes and messages relayed from the services I have linked. Once your Mobile Number is confirmed, and before any other messages are sent, we send you a confirmation message substantially like the following:

Multifactor Solid2FA: You are now opted in to receive verification codes and relayed messages at this number. Msg frequency varies. Msg & data rates may apply. Reply HELP for help or STOP to cancel.

Your opt-in applies only to the Program and only to the Mobile Number that you confirmed. It is not transferable to any other program, sender, or number. We keep a record of your opt-in, including the date and time, the disclosure you agreed to, the Mobile Number, and the Account that provided it, so that we can honor your choices and demonstrate your consent.

By opting in, you represent and warrant that: (a) you are at least 18 years old; (b) you are the subscriber to, or the customary user of, the Mobile Number and are authorized to consent to receive text messages at it; (c) the Mobile Number is accurate; and (d) you will promptly update or remove the Mobile Number in Settings if you change it, stop using it, or otherwise lose the right to consent on its behalf, so that messages are not sent to someone else.

3. MESSAGE FREQUENCY

The Program sends recurring messages. Message frequency varies and depends on how many Linked Services you connect to your Solid2FA Number, how often those services send messages, and which delivery options you turn on. For example, each sign-in to a Linked Service that sends a verification code may result in one relayed message.

4. MESSAGE AND DATA RATES

Message and data rates may apply. Your wireless carrier may charge you for each text message that you receive or send under its standard messaging and data rates, and additional charges may apply if you are roaming. You are solely responsible for all such charges. We do not charge a separate fee for text messages, and the Program is not a premium (surcharged) messaging service. Any fees that we charge for Solid2FA or other paid features are disclosed separately when you purchase them.

5. HOW TO OPT OUT

You can stop receiving text messages from us at any time by any of the following methods:

  • reply STOP to any text message from us (we also honor END, QUIT, CANCEL, UNSUBSCRIBE, OPT OUT, and REVOKE, in any capitalization, and any other clear request to stop);
  • remove your Mobile Number, or turn off text delivery, in the Solid2FA section of Settings; or
  • email [email protected] from the email address associated with your Account and ask us to stop.

After you opt out, we will send one final message confirming that you have opted out, and we will not send further text messages to that Mobile Number unless you opt in again. We honor opt-out requests promptly, and in any event within 10 business days of receipt. Opting out of text messages does not close your Account or turn off Solid2FA: messages sent to your Solid2FA Number remain available inside the Multifactor application. To opt in again, add and confirm your Mobile Number in Settings.

6. HELP AND SUPPORT

7. CARRIERS AND DELIVERY

The Program is available only in the countries and on the carriers that we support. In the United States, the Program is supported by major carriers, including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages. Delivery of text messages depends on your carrier and device and may be delayed, filtered, or fail for reasons outside our control. Do not rely solely on text delivery for time-sensitive codes: messages sent to your Solid2FA Number are always available inside the Multifactor application, which is the primary place they are delivered.

We may filter, delay, or decline to relay any message that we reasonably believe is unlawful, fraudulent, or prohibited by wireless carrier or messaging industry rules, and we may modify, suspend, or discontinue the Program (in whole or in part) at any time, with or without notice. We may also stop sending messages to a Mobile Number that we learn has been disconnected or reassigned.

8. YOUR SOLID2FA NUMBER

Your Solid2FA Number is assigned to you for the purpose of receiving verification codes and account messages from Linked Services. It is not a personal phone line and must not be used to contact emergency services (including 911 or text-to-911), as an emergency contact, or for any purpose other than receiving messages from Linked Services. Solid2FA Numbers remain our property, cannot be ported to another carrier, and may be changed or withdrawn by us; we may also assign the same Solid2FA Number to more than one user for use with different Linked Services. You agree to link only accounts that you own or are authorized to manage, to comply with each Linked Service’s terms, and not to use your Solid2FA Number for any unlawful purpose.

9. PRIVACY

We do not share, sell, rent, or provide your Mobile Number, your SMS opt-in, or your consent status to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for the wireless carriers and text messaging service providers that help us deliver messages to you, which may use that information only for that purpose. Our Privacy Policy describes how we collect, use, and protect your information, including the information involved in the Program.

10. CHANGES TO THE SMS TERMS

We may update the SMS Terms from time to time. If we make material changes, we will notify you as described in the Terms of Use, and the updated SMS Terms will apply to the Program going forward. If you do not agree to the updated SMS Terms, opt out as described in Section 5.
